12:00 pm the case against a former marine-- who says he shot an killed a burglary suspect -- has been dismissed. within the last hour-- the word was handed down-- in the luke sanchez hearing-- in valencia county. austin reed is live-- at the court-- with reaction in today's decision. austin? today's hearing lasted just under two hours, with judge danny hawkes delivering a final verdict in the luke sanchez case... dismissed. -- by simply saying: "there was no probable cause found" the state tried to charge the former marine, with second degree murder, or voluntary manslaughter for shooting and killing gary gabaldon back in july. sanchez says he spotted gabaldon, and another person allegedly breaking into the enchantment propane business in belen. sanchez called 9-1-1 to report what was going on. he then followed the suspects in his car...minutes later sanchez says galbadon attacked him, so he shot him in the face, killing him. sanchez has said all along that
