I encountered this glitch when trying to infiltrate the Assassin's Tomb in Tuscany. As you can see, I was notorious. Yet the guard did nothing. I tried to assassinate him and attack him, but neither worked! Apologies for the bad quality, I quickly recorded it with my iphone camera.
